Terms and Conditions

Article 1 (Purpose)

The purpose of this Agreement is to prescribe the rights, duties, and responsibilities of the website mall and users in using Internet-related services (hereinafter referred to as "services") provided by the website operated by DaCaPo Institute of Technology (hereinafter referred to as "mall").

 This Agreement shall apply mutatis mutandis to e-commerce transactions using PC communication, wireless, etc., unless they are contrary to their nature.」

 

Article 2 (Definition)

1. "Mall" means a virtual business place where DaCaPo Institute of Technology can trade goods or other goods using information and communication facilities such as computers to provide goods or services to users (hereinafter referred to as "goods, etc.") and also uses the meaning of a cybermall operator.

2. "Users" means members and non-members who access "mall" and receive services provided by "mall" under these terms and conditions.

3. 'Members' means persons who have registered as members of the "Mall" and are able to use the services provided by the "Mall" continuously.

4 'Non-member' refers to a person who does not sign up as a member and uses the services provided by "mall".

 

Article 3 (Excription, explanation, and revision of terms, etc.)

1."Mall" is the contents of this Agreement and the name of the representative, the address of the location of the Sales Office (including the address of the place where the consumer's complaint can be dealt with), and the telephone number.It is posted on the 00 Cyber Mall's initial service screen (front) so that users can easily understand the simulation transmission number, e-mail address, business registration number, communication business report number, and personal information protection manager. However, the contents of the terms and conditions can be viewed by the user through the connection screen.

2. "Mall" withdraws the subscription from the contents set out in the terms and conditions before the user agrees to the terms and conditions.In order for users to understand important contents such as delivery responsibility, refund conditions, etc., a separate connection screen or pop-up screen shall be provided to obtain confirmation from the user.

3. "Mall" may not violate the Electronic Commerce Act, the Regulation of Terms and Conditions, the Electronic Documents and Electronic Transactions Act, the Electronic Financial Transactions Act, the Information and Communication Network Act, the Visit Sales Act, and the Consumption Act.

4. In the event that "Mall" amends the terms and conditions, the date of application and the reason for the amendment shall be specified and announced on the initialization page of the mall from 7 days before the date of application to the day before the date of application. However, if the terms and conditions are changed unfavorably to the users, the notice will be made with a grace period of at least 30 days. In this case, "mall" clearly compares the contents before and after the revision to make it easier for the user to understand.

5. If "Mall" amends the terms and conditions, the amended terms and conditions shall apply only to contracts concluded after the application date, and the previous terms and conditions shall apply to contracts already concluded before that date. However, the amended terms and conditions shall apply where a user who has already signed a contract sends his/her wish to be subject to the amended terms and conditions to the "mall" within the notice period of the amended terms and conditions under paragraph (3).

6. Matters not prescribed in these terms and conditions and interpretations of these terms and conditions shall be governed by the Consumer Protection Guidelines and related laws and regulations on consumer protection, regulations, etc. in e-commerce and e-commerce prescribed by the Fair Trade Commission.

 

Article 4 (Provisions and modifications of services)

1."Mall" performs the following tasks:

  1. Provide information on goods or services and conclude a purchase contract

  2. Delivery of goods or services with purchase contracts

  3. Other tasks determined by "mall"

2."Mall" may change the contents of the goods or services to be provided by the contract in the future in the event of a failure of goods or services or a change in technical specifications. In such cases, the contents of the changed goods or services and the date of delivery shall be immediately notified to the place where the current goods or services are posted.

3.If the contents of the service contract signed with the user by "Mall" are changed for reasons such as the sale of goods, etc. or the change of technical specifications, the user shall immediately be notified of the reason.

4. In the case of the preceding paragraph, "Mall" shall compensate for damages incurred by the user. However, this is not the case if "mall" proves that there is no intention or negligence.

 

Article 5 (Discontinuation of Service)

1. "Mall" is a maintenance inspection of information and communication facilities such as computers.In the event of a replacement, failure, or interruption of communication, the provision of the service may be temporarily suspended.

2. "Mall" shall compensate users or third parties for damages caused by the temporary suspension of service for the reason referred to in paragraph (1). However, this is not the case if "mall" proves that there is no intention or negligence.

3. In the event that the service is unable to be provided due to the conversion of business items, abandonment of business, or integration between businesses, "mall" shall notify the user in the manner prescribed in Article 8 and compensate the consumer according to the conditions originally set forth in "mall". However, if "mall" does not notify the compensation standard, etc., the users' mileage or reserves will be paid in kind or cash equivalent to the currency value used in "mall".

 

Article 6 (Membership)

1. Users sign up for membership by stating that they agree to this agreement after completing the membership information according to the registration form set by "Mall".

2. "Mall" shall be registered as a member from among users who have applied for membership as referred to in paragraph (1) unless they fall under any of the following:

  1. Except in cases where an applicant has previously lost his/her membership under Article 7 (3) of this Agreement, he/she shall have obtained approval for membership of "Mole" three years after he/she has lost his/her membership under Article 7 (3).

  2. If there is a false, missing, or misleading information in the registration details

  3. Where it is deemed that registering as a member is significantly impaired by the technology of "mall".

3. The membership contract shall be established at the time when the "mall" has reached the members's approval is reached by the members.

4. If there is a change in the registered matters at the time of membership registration, the member shall notify "mall" of the change by modifying the membership information within a considerable period of time.

 

Article 7 (Membership withdrawal, disqualification, etc.)

1. Members may request withdrawal from the "mall" at any time, and "mall" will immediately process the withdrawal of the membership.

2. Where a member falls under any of the following reasons, "mall" may restrict or suspend his/her membership:

  1. If false information is registered at the time of application for membership

  2. Where the member does not pay the amount of goods purchased using "mall" or other debts incurred by the member in connection with the use of "mall" on the due date;

  3. Where an e-commerce order is threatened by obstructing other people's use of "mall" or stealing such information;

  4. In case the Act or these terms and conditions are prohibited or act contrary to the official documents using "mall";

3."Mall" limits membership.If the same act is repeated more than two times after suspension or the reason is not corrected within 30 days, "mall" may lose its membership.

4. If "Mol" loses its membership, cancel the membership. In such cases, the member shall be notified and given the opportunity to explain for a period of at least 30 days prior to the cancellation of the membership registration.

 

Article 8 (Notification to Members)

1.If "Mall" gives notice to the member, the member may make it to the email address specified by the member in advance under a prior agreement with "Mall".

2. "Mall" may be substituted for individual notices by posting them on the "Mall" bulletin board for at least one week for unspecified number of members. However, each member shall be notified of matters that have a significant impact on his/her transaction.

 

Article 9 (purchase application)

1."Mall" users shall apply for purchase at "Mall" by the following or similar means, and "Mall" shall provide each of the following information in a manner that the user applies for purchase:

  1. Search and select goods, etc.

  2. Enter the recipient's name, address, phone number, e-mail address (or mobile phone number)

  3. Terms and conditions, services with limited withdrawal rights, and shipping charges.Confirmation of the contents related to the cost of installation, etc.

  4. An indication that you agree to these terms and conditions and confirm or reject any of the above 3. (e.g., click the mouse)

  5. Application for purchase of goods, etc. and confirmation of such purchase or consent to confirmation of "mall";

  6. Choosing a payment method

2. If "Mall" needs to provide or entrust the buyer's personal information to a third party, the buyer's consent shall be obtained at the time of the actual purchase application, and the consent shall not be comprehensively obtained upon membership. At this time, "mall" shall state to the purchaser the personal information items provided, the purpose of the use of personal information of the recipient, the period of possession and use, etc. However, in the case of entrustment of personal information processing under Article 25 (1) of the Information and Communication Network Utilization Promotion, Information Protection, etc., it shall be governed by the relevant statutes.

 

Article 10 (Procession of Contract)

1."Mole" may not accept a purchase application under Article 9 if it falls under any of the following subparagraphs: However, if a minor signs a contract with a minor, he/she shall notify the minor himself/herself or his/her legal representative that the contract may be canceled if he/she fails to obtain consent from the legal representative.

  1. False, missing, or false information in an application

  2. Where a minor purchases goods or services prohibited by the Juvenile Protection Act, such as tobacco or alcohol;

  3. Where it is deemed that accepting other purchase applications is significantly impaired by "mall" technology;

2. The contract shall be deemed to have been concluded when the acceptance of "Mol" reaches the user in the form of a notification of receipt under Article 12 (1).

3. The expression of acceptance of "Mol" shall include information on confirmation of the purchase application and availability of the purchase application, cancellation of the purchase application, etc.

 

Article 11 (Payment Method)

Payment methods for goods or services purchased at the "Mall" may be made in the following ways: Provided, That "mall" shall not be collected by adding any nominal fee to the payment of goods, etc. for the user's payment method.

1. Transferring various accounts such as phone banking, Internet banking, mail banking, etc.

2. Payment of prepaid cards, debit cards, credit cards, etc.

3. Deposit without an online passbook

4. Payment by e-money

5. Payment on receipt

6. Payment by points paid by "Mall" such as mileage

7. Payment by gift certificate under contract with "Mall" or recognized by "Mall"

8. Other electronic payment methods such as payment, etc.

 

Article 12 (Receive confirmation notice.Change and cancel purchase application)

1."Mall" notifies the user of the receipt confirmation upon the user's purchase request.

2. A user who has received a receipt confirmation notice can request the change or cancellation of the purchase request immediately after receiving the receipt confirmation notice, and "mall" shall be processed at the request without delay. However, if the payment has already been made, the provisions concerning withdrawal of subscription, etc. under Article 15 shall apply.

 

Article 13 (supply of goods, etc.)

1. "Mall" takes other necessary measures, such as custom production and packaging, to deliver goods within seven days from the date of application, unless there is a separate agreement between the user and the time of supply of goods. However, if "Mall" has already received all or part of the payment for goods, etc., it shall take action within three business days from the date of receipt of all or part of the payment. At this time, "mall" takes appropriate measures so that users can check the supply procedures and progress of goods, etc.

2. "Mall" specifies the means of delivery, the person responsible for the delivery cost by means, and the delivery period by means of goods purchased by the user. If "mall" exceeds the agreed delivery period, the user shall be compensated for damages. But "mole" is intentional.This is not the case if you have proven that you are not culpable.

 

Article 14 (Refund)

"Mall" shall notify the user of the reason when the goods requested for purchase, etc. are unable to be delivered or provided due to reasons such as sold out, and if the payment is received in advance, refund or take necessary measures within three business days from the date of receipt of the payment.

 

Article 15 (Revocation of subscription, etc.)

1 "Mall" and users who have entered into a contract for the purchase of goods, etc. may withdraw their application within 7 days from the date of receipt of a written contract under Article 13 (2) of the Electronic Commerce, etc. Act (referring to the date of supply of goods, etc. However, the provisions of the Act on the Protection of Consumers in Electronic Commerce, etc. shall apply to withdrawal of subscription.

2. Users are not allowed to return goods or exchange goods if they are delivered in any of the following cases:

  1. Where a good, etc. is lost or damaged due to a cause responsible to the user (However, if the package, etc. is damaged to verify the details of the good, etc., the subscription may be withdrawn.)

  2. Where the value of goods, etc. has significantly decreased due to user use or some consumption;

  3. Where the value of goods, etc. has significantly decreased over time to the extent that resale is difficult;

  4. If a good with the same performance can be duplicated, such as a good with the same performance, etc., the packaging of the original good, etc. is damaged;

3. In the case of paragraphs (2) 2 through 4, the withdrawal of subscription by users is not restricted unless measures such as specifying the fact that "mall" is restricted in advance, such as providing a trial product, etc.

4. Notwithstanding the provisions of paragraphs (1) and (2), users may withdraw their subscription within three months from the date of receipt of the goods, etc., or within 30 days from the date of receipt of the goods, etc. or from the date of discovery.

 

Article 16 (Effect of withdrawal of subscription, etc.)

1."Mall" will refund the amount of goods, etc. already paid within three business days if the goods, etc. are returned by the user. In such cases, when "mall" delays the refund of goods, etc. to the users, the delayed interest rate calculated by multiplying the delay period by Article 21-2 of the Enforcement Decree of the Consumer Protection Act on Electronic Commerce, etc. (delete the brackets).

2. "Mall" requests the operator who provided the payment method to suspend or cancel the claim for the goods, etc. without delay when the user pays the goods, etc. by credit card or electronic currency, etc. in refunding the above payment.

3. In the case of withdrawal of subscription, etc., the user shall bear the expenses incurred in returning the goods, etc. supplied. "Mall" shall not claim penalty or compensation for damages from the user on the grounds of withdrawal of subscription. However, if the contents of the goods, etc. are different from the contents of the display or advertisement, or the contents of the contract are implemented differently than the contents of the contract, the expenses necessary for the return of the goods, etc., shall be borne by "mall".

4. If the user pays for shipping when receiving goods, etc., "Mall" clearly indicates who will pay for the goods when withdrawing the subscription.

 

Article 17 (Personal Information Protection)

1. "Mall" collects minimum personal information to the extent necessary for providing services for users' personal information collection.

2. "Mall" does not collect information necessary for the fulfillment of purchasing contracts in advance when members sign up. However, this shall not apply to cases where personal identification is required prior to the purchase contract in order to fulfill the obligations under the relevant statutes, and where the minimum specific personal information is collected.

3. When collecting and using the user's personal information, "mall" shall notify the relevant user of the purpose and obtain his/her consent.

4. "Mall" shall not use the collected personal information for any purpose other than its purpose, and where a new purpose of use occurs or is provided to a third party, the user shall be notified of the purpose and agreed upon. However, exceptions shall be made in cases where other laws and regulations are prescribed.

5. Where "mall" is required to obtain the consent of users pursuant to paragraphs (2) and (3), the person in charge of personal information protection (affiliated, name and telephone number, other contact information collection purpose and use of information to third parties shall withdraw the in advance of Article 22

6. Users may at any time request to read or correct their personal information and "mall" shall be obliged to take necessary measures without delay. If a user requests an error correction, "Mall" does not use the relevant personal information until the error is corrected.

7. "Mall" shall limit the number of users who process their personal information to a minimum, and shall take full responsibility for damages caused by loss, theft, leakage, non-consent third-party provision, tampering, etc. of users' personal information, including credit cards, bank accounts, etc.

8. A third party that receives personal information from "mall" or a third party shall destroy such personal information without delay when it achieves the purpose of collecting or receiving personal information.

9. "Mall" does not set the consent box for the collection, use, or provision of personal information as preselected. In addition, services that are restricted when users refuse to agree to collect, use or provide personal information shall not be specifically specified, and services such as membership registration shall not be restricted or rejected due to the user's refusal to agree to collect, use or provide personal information other than mandatory collection items.

 

Article 18 (Duties of the Mall)

1. "Mol" shall not be prohibited by Acts and subordinate statutes or these terms and conditions or engage in any act contrary to the official documents, and shall be continuously and reliably produced as prescribed by these terms and conditions.We must do our best to provide the service.

2. "Mall" shall have a security system for the protection of users' personal information (including credit information) so that users can safely use the Internet service.

3."Mall" indicates the goods or services.an unjustified indication of Article 3 of the Act on the Fairness of AdvertisingIf a user suffers damage by advertising, he/she shall be responsible for compensation.

4. "Mall" does not send advertising e-mail for profit-making purposes that you do not want.

 

Article 19 (Duties to the ID and password of a member)

1. Except in the case of Article 17, the member shall be responsible for managing the ID and password.

2. Members shall not allow third parties to use their ID and password.

3.If a member recognizes that his ID and password have been stolen or used by a third party, he or she should notify "Mol" immediately and follow the instructions of "Mol".

 

Article 20 (User's Duty)

The user shall not do the following:

1. Registration of false information upon application or modification

2. Information theft from others

3. Change information posted to "Mall"

4. Send or post information (such as computer programs) other than information prescribed by "mall".

5. Violation of intellectual property rights, such as copyrights of "mall" and other third parties;

6. "Mol" Other acts that damage the reputation of a third party or interfere with business;

7. Disclosure or posting of obscene or violent messages, images, voice, or other information against public notice in the mall;

 

Article 21 (Relationship between Connected "Mall" and Connected "Mall")

1.If the top "mall" and the bottom "mall" are linked by hyperlinks (for example, targets include text, pictures, and fairy tales), the former is called the "mall" (website), and the latter is called the "mall" (website).

2 Connection "mall" shall not be held liable for any transaction made with the user by the connected "mall" independently provided by the connected "mall" on the initial or pop-up screen at the point of connection.

 

Article 22 (Restriction and Use Restriction of Copyright)

1. Copyright and other intellectual property rights to the work written by "Mall" are attributed to "Mall".

2. Users shall not use information attributed to "mall" for profit or use by means of reproduction, transmission, publication, distribution, broadcasting, or other means without prior consent from "mall".

3. "Mall" shall notify the user of the copyright attributed to the user in accordance with the agreement.

 

Article 23 (Discussion Resolution)

1. "Mall" shall establish a damage compensation processing organization to reflect legitimate opinions or complaints raised by users and to compensate for such damage.I'm running it.

2. "Mall" deals with complaints and opinions submitted by the user first. However, if it is difficult to handle it quickly, we will immediately notify the user of the reason and processing schedule.

3. In the event of a user's application for damage relief in connection with an e-commerce dispute between "mall" and users, it may be subject to mediation by the Fair Trade Commission or the city/provincial governor.

 

Article 24 (Trial Rights and Compliance Act)

1. A lawsuit concerning an e-commerce dispute between a "mall" and a user shall be subject to the user's address at the time of the complaint, and if there is no address, it shall be governed exclusively by the local court in charge of the residence. However, if the address or address of the user is not clear at the time of the complaint or a foreign resident, it shall be filed with the competent court under the Civil Procedure Act.

2 Korean law applies to e-commerce lawsuits filed between "mall" and users.
